The Health Professions Council of South Africa (HPCSA) at a meeting held in Pretoria on 24 November 2008 took a decision to scrap its ethical tariffs used by doctors as a ceiling for patient accounts. This decision follows the establishment of a new National Health Reference Price List (NHRPL) by the Department of Health including an extensive consultative process with stakeholders, as well as healthcare practitioners.

 

“The HPCSA ethical tariffs were previously used to guide us in determining whether or not a practitioner had over-charged a patient,” explained HPCSA Registrar, Adv. Boyce Mkhize “however, the Department of Health’s new processes around the NHRPL which embraces all healthcare players within the country, eliminates the need to determine our own tariff which has historically been three times higher than the NHRPL.”

 

As a regulatory body protecting the public consumers of healthcare services, the HPCSA will, however, still retain its authority to determine whether a practitioner has overcharged a patient or not, in terms of Section 53 of the Health Professions Act 1974. In order to make this determination, the HPCSA has adopted the following principles:

 

 a practitioner shall charge a non-insured patient the NHRPL rate except where the patient provides written informed consent for a billing higher than the NHRPL rate and any charge above the NHRPL rate without the patient’s consent shall be deemed to be overcharging;
 a practitioner may charge a private-paying insured patient a rate payable by the Medical Scheme in which that patient belongs or is a member if it is higher than the NHRPL rate provided that any rate higher than the rate payable by the Medical Scheme shall be deemed to be overcharging, except where the patient has given written informed consent for a charge higher than the Medical Scheme rate; and
 for the purposes of determining whether the patient has provided informed consent, the practitioner is required to indicate to the patient the prevailing NHRPL or Medical Scheme rate for whatever procedure the patient presents for as well as the difference between that rate and the rate the practitioner intends to charge as well as the amount that the patient may have to pay in addition to the stipulated rate.

 

“We believe this pronouncement by the HPCSA will not only provide guidance to our healthcare practitioners while clearing the confusion prevalent within the healthcare industry where there is more than one tariff, but will also provide protection to the South African public by ensuring that costing models do not unduly hamper access to healthcare.”

With South Africa being one of the countries striving to curb brain drain especially in the health sector, the Health Professions Council of South Africa (HPCSA) has accelerated its initiative to have Tunisian medical practitioners practice in the country's public health institutions.

 

Council has already registered 100 practitioners from Tunisia and these are ready to serve in the various rural areas across South Africa . Not only is the initiative aimed at alleviating shortages in the rural areas, but also share expertise with their local counterparts. In so doing, the rural areas that have always had shortages of healthcare practitioners will benefit greatly.

 

Council will continue expeditiously processing the documents as they arrive from the Department of Health's Foreign Workforce Management Programme. Registered Tunisian medics will ply their trade in some of the underserviced areas.

Rising administrative costs have coerced the HPCSA to increase the annual fees paid by practitioners with effect from 1 April 2008.

 

Different percentages have been allocated to different Professional Boards based on the formula used internally which takes into account the number of practitioners on the register and the combined income strength.

 

Other factors attributed to the increase include the rising costs in executing the disciplinary cases which Council is legally obligated to investigate and where necessary prosecute.

 

The different fees practitioners pay are determined by the activities of the Board through the financial year, including meetings undertaken, examinations as well as the various committees that look into different Board issues.

 

Last year, Council’s increases were nominal and the year previous to that no increases were effected, resulting in a huge strain on the budget.

 

Hardest hit are the Speech Language and Hearing (SLH) Professions as well as the Dental Therapy and Oral Hygiene (DOH) Professional Boards that have seen a significant increase. The majority of practitioners in these Boards will now have to fork out R1 049 and R1 028 respectively.

 

The lowest paying practitioners are food inspectors in the Environmental Health Professional Board who are expected to pay R90 a year. Doctors and dentists in the Medical and Dental Professions Board are now paying R1 090 and R1 091 respectively including a special levy of R171.00 aimed at covering their legal costs. “The figures we reached are not grotesque and Council will continue looking at better models of financing its business so as to alleviate the burden on practitioners,” said Council Registrar, Adv Boyce Mkhize.

 

The HPCSA is not subsidised by government and to meet its mandate of protecting the public and guiding the professions, it relies heavily on fees and fines that practitioners pay.

The HPCSA has learnt with dismay that the new load shedding schedule may include hospitals for periods of up to 4 hours a day without power. Such major hospitals as Johannesburg Hospital are said to be on the list of hospitals that may soon be without power for prolonged periods of time.

 

The HPCSA and its practitioners are there to ensure public protection and to promote ongoing quality of healthcare. Load shedding in hospitals can only compromise patient health as our practitioners can barely assist patients once load shedding sets in, and are thus rendered useless. “This will have disastrous effects on the lives of many patients and the HPCSA condemns this move and urges the authorities concerned to find suitable alternatives such as isolating the hospitals from the load shedding schedules or providing alternative power supply to these institutions”, said HPCSA Registrar and CEO, Adv Boyce Mkhize.

 

Should there be any negative consequences on the lives of the patients that can be directly attributed to the load shedding crisis, those responsible should be made to bear the responsibility and consequences of their actions, Mkhize added.

 

Although some operations can be scheduled in advance thus enabling practitioners and hospitals to plan their operation schedules beforehand, some operations arise out of emergency situations and cannot be postponed without dire consequences on the lives of the patients. We urge the government and authorities involved to find an urgent solution to this looming crisis.

The Health Professions Council of South Africa (HPCSA) has learnt with shock and disapproval of a practice which seems to be escalating in the health industry where certain medical aid schemes and Preferred Provider Networks (PPN) tend to coerce practitioners into settlement agreements for over-servicing of patients or even fraudulent claims.

 

The HPCSA receives complaints regarding practitioners who over-charge patients and some who defraud medical aid schemes, usually in the form of either claiming for services not rendered or inflating the claims. As a regulatory body, the HPCSA is obliged to investigate and where necessary prosecute such acts of misconduct.

 

Lately, it seems that some medical aid schemes have resorted to enter plea-bargains with practitioners they believe may have over-charged patients and through instilling some pressure politely coerce practitioners to pay back the money alleged to have been overcharged or defrauded from the scheme in return for the settlement agreement being kept under wraps. This means the parties agree not to have the misdemeanour reported to the HPCSA for an ethical conduct investigation or to the law enforcement agencies for criminal prosecution, provided the practitioner undertakes to settle whatever amount he or she may be said to be owing.

 

We find this conduct abusive to the practitioners and somewhat amounting to defeating the ends of justice in that practitioners are sometimes made to pay monies they do not owe just to save their reputation and hassles of an ethical or criminal conduct investigation. Practitioners feel extorted through the pressure placed upon them to co-operate or else be referred to the HPCSA or SAPS.

 

We wish to record that medical aid schemes do not have authority to harass or through some form of extortion, coerce practitioners into settlement agreements, other than for the normal civil remedies they may have to institute action for what is legally due to them. Neither do the medical aid schemes have the choice not to report fraudulent activities or unprofessional conduct to the relevant bodies like the HPCSA in exchange for a settlement agreement. We therefore urge practitioners and medical aid schemes alike to refrain from such conduct as it may amount to both unprofessional and criminal conduct in respect of both.

 

We are also getting concerned about the reported conduct of some Preferred Provider Networks Administrators, particularly in the Optometry profession which tend to abuse their powers by ordering random and unsolicited audits of many professional practices with a view to extorting some money from professionals under the guise of a forensic audit investigation. We have learnt with shock how some of these administrators threaten practitioners with audits going as far back as three years on their claims patterns so that if they find something untoward or that cannot be readily explained, the practitioner is made to enter into a settlement agreement, with an express undertaking to service the debt, failing which the matter may be escalated to the HPCSA. Firstly, PPN Administrators should not have such far ranging powers where they can enter premises will-nilly, search and seize documentation based on nothing and conduct these inordinately long audits. Such conduct borders on violation of the practitioner’s constitutional right to privacy and fair administrative action.

 

The HPCSA does not condone over-servicing or fraudulent behaviour on the part of its professionals and thus believes that practitioners guilty of such acts should receive appropriate penalties through proper disciplinary mechanisms. However, it should not be assumed that practitioners are guilty until proven otherwise as we have a significant majority of our practitioners practicing their profession ethically, professionally and with dignity. PPN Administrators should therefore not have the authority to conduct the so-called audits without a clear basis for doing so. Neither should these administrators be allowed to pressurize practitioners into settlement agreements on the basis of untested claims and fail to report same to the relevant bodies such as the HPCSA.

The Health Professions Council of South Africa (HPCSA) has queried the authenticity of qualifications of students coming from some Emergency Care Training colleges in the Pretoria and Stanger areas.

 

The South African First Aid League (SAFAL) is being investigated after it emerged some students hold qualifications from institutions claiming to be affiliated to it. Though SAFAL is accredited and allowed to train students, other colleges are training under its banner as satellite campuses.

 

Further, the HPCSA has learnt that Ebuhleni Pre-Nursing School in Pretoria and one institution in Stanger are unaccredited institutions that are rendering training to unsuspecting students.

 

Every institution offering emergency care training must be accredited and is obliged to comply with conditions of accreditation as well as the education and training standards as determined by the HPCSA’s Professional Board for Emergency Care.

 

The HPCSA will not register anyone holding a qualification from an unaccredited institution and students must check first to ensure the training colleges they are enrolling in are accredited institutions.

 

Currently there are 56 HPCSA accredited institutions across the country and a full list can be accessed from its website.

In an effort to obtain mammograms of desired quality, protect patients from unnecessary radiation and meet international norms, the Health Professions Council of South Africa (HPCSA) has announced that radiographers involved in mammography procedures will in future be required to hold a post graduate qualification.

 

This follows a pronouncement by the Department of Health’s Directorate – Radiation Control that all mammography procedures must be performed by qualified radiographers holding a post graduate qualification.

 

Licence holders are expected by 30th June 2008 to provide written proof to the Directorate: Radiation Control that radiographers involved in mammography procedures have been either enrolled in a recognized training course or have obtained the required additional qualification in mammography.

 

Following concerns on the inadequate consultation by the Radiation Control Directorate in the implementation of additional licensing requirements, the 30th June 2008 date is currently under review. The practitioners are being urged to make efforts to meet the stipulated requirements.

 

A process has also been approved and guidelines developed by the HPCSA’s Professional Board for Radiography and Clinical Technology for the recognition of prior learning. This is for experienced Radiographers who, as at 1 January 2008, had been performing mammography procedures for a minimum of four years.

 

There are currently five educational institutions in the country offering the additional mammography course. Radiographers wishing to apply for recognition of prior learning are also advised to contact these institutions. For licensing purposes, the following qualifications are recognised:
• Certificate in Mammography – University of Johannesburg
• Certificate in Mammography – Durban University of Technology
• Certificate in Breast Imaging – Central University of Technology/University of the Free State
• Certificate in Mammography – University of Pretoria
• Certificate in Mammography – Cape Peninsula University of Technology

The Health Professions Council of South Africa (HPCSA) has expressed concern over some of its practitioners involved in illegal activities including defrauding medical aid schemes.

 

This comes in the wake of one Pretoria East doctor arrested recently together with a pharmacist for allegedly defrauding medical aid schemes since 2005.

 

The HPCSA will investigate the alleged claims though it subscribes to the notion of everyone being innocent until proven otherwise.

 

In addition to complaints of unauthorised claims being received, the organisation has urged medical aid schemes to be vigilant and scrutinise claims from practitioners to ensure they are genuine.

 

While such illegal activities are most certainly not representative of the highly learned and respected caliber of the medical doctors in South Africa, HPCSA expects transgressors to refrain from activities that put their profession into disrepute.

 

“The HPCSA views fraudulent claims as serious transgressions not only because this is unethical and dishonest, but also because they consequently lead to hikes in medical aid premiums which hit consumers of healthcare services the hardest,” said HPCSA Registrar, Advocate Boyce Mkhize.

Health care practitioners in South Africa and the African region are in for a major information boost in the second week of October 2008 as the International Association of Medical Regulatory Authorities (IAMRA) conference heads to Cape Town.

 

To be held from 6 to 9 October 2008, the biennial conference - the first in Africa - will give all healthcare practitioners the chance to meet various role players from around the globe and the chance to learn of the latest trends within the healthcare sector.

 

The conference will touch on pertinent issues on professionalism, the role of the public and patients as well as issues on staff burnout, lack of equipment and infrastructure in the healthcare sector and demands for quality healthcare.

 

“We have no doubt this is a rare opportunity for those in the healthcare sector to get together, get new ideas and information and the chance to see if they are moving in the right direction in comparison to their counterparts in other regions,” said HPCSA Registrar, Advocate Boyce Mkhize.

The Health Professions Council of South Africa (HPCSA) has raised concerns over the flood of advertisements by people claiming to be doctors and “experts” in pregnancy termination and has warned the public to avoid such individuals.

 

This comes in the wake of countless “advertisements” plastered mostly on street poles and buildings.

 

The fact that names are only written as Dr Cure, Dr John, Dr Liezl etc is clear indication these people are not registered with the HPCSA or any organization as the full details are not given including registration numbers or the premises where they operate from.

 

The HPCSA warns the public to be on the look out for bogus doctors who claim to do abortion. Only qualified medical people are allowed to carry out abortions.

 

Members of the public are encouraged to check with the HPCSA on 012 338 9301 to see if the people they go to for medical attention are registered practitioners.

 

Unfortunately the HPCSA has no jurisdiction over bogus practitioners and anyone masquerading as medical practitioner must be reported to the police. Working as a medical person without the registration of the relevant regulatory authority is a criminal act.

 

“We are concerned about the mushrooming of these illegal practitioners as they not only put the lives of people at risk due to unscientific methods they employ but also due to the fact that they cannot be held accountable by the HPCSA in case of negligence and complications arising from their interventions,” said HPCSA Registrar, Advocate Boyce Mkhize.

Thousands of healthcare practitioners registered with the Health Professions Council of South Africa (HPCSA) will be erased from the register during August for failing to pay their annual fees. Practicing without HPCSA registration is a criminal offence in terms of the Health Professions Act of 1974.

 

Nearly 12 000 practitioners (including doctors, dentists, occupational therapists, psychologists, optometrists, emergency care practitioners and many others) have not yet paid their annual fees and will therefore be scrapped from the HPCSA’s register of practitioners. Healthcare practitioners registered with the Council are expected to pay their fees by 1 April every year to allow them to retain their registration status. However, the HPCSA gave practitioners a three month grace period and this has now expired.

 

Under the Health Professions Act of 1974, registration with the HPCSA is a prerequisite to practice any of the professions under the jurisdiction of the Council. To verify whether practitioners are indeed registered to practice, patients can ask heath care practitioners to produce their practicing cards which are valid for one year, or alternatively contact the HPCSA Call Centre on 012 338 9300.

 

In terms of the Act, erasures can take place within three months after the deadline. Once erased from the register for non-payment of annual fees, practitioners who pay within six months, will face a penalty fee of twice the annual fee as well as the outstanding fees. Those who apply for restoration after six months, but within twelve months after the erasure date will pay four times the usual annual fee plus the outstanding amount, and for periods exceeding twelve months of the erasure date, an amount equivalent to five times the applicable annual fee for the current year, plus outstanding fees will be payable.

 

“Practitioners are reminded annually of the amount they are required to pay as well as the due date. We realise that the penalty fees prescribed in the Act are high and therefore allowed practitioners a grace period of three months in which to settle their accounts. Some of our practitioners are unemployed or are not currently practicing which is why there is a provision in the Act to apply for voluntary erasure to avoid paying the hefty penalty fees in such circumstances,” said HPCSA Registrar, Adv Boyce Mkhize.

Following its first initiative to ensure no illegal practitioners are serving the public, the Health Professions Council of South Africa (HPCSA) has vowed to intensify its blitz to ensure illegal practitioners are stopped.

 

Reports have been received by the HPCSA of certain individuals operating without registration and this has prompted Council to embark on random checks.

 

Those visited today in Pretoria’s Sunnyside area were found to be compliant except one practitioner at Arcadia’s Nedbank Plaza, Pretoria who bolted after HPCSA’s legal officials introduced themselves.

 

“Our checks have been prompted by certain individuals who are dispensing health care services without registration with the relevant regulatory authorities. As a regulatory body, we must ensure the public receive quality health care from qualified and competent practitioners said HPCSA Registrar, Adv Boyce Mkhize.

 

The HPCSA’s exercise, conducted in conjunction with the police, which will be extended to other provinces is one way Council is fulfilling its mandate of protecting the public as many people are unable to distinguish a registered practitioner from an unregistered one.

 

The HPCSA encourages the public to check if a practitioner is registered by phoning its Call Centre on 012 338 9301 or to ask the practitioner to produce his current practicing card.

 

“Most of our practitioners are trained, qualified and registered but there are a small percentage of those operating illegally and are bringing the health care service into disrepute. We do not want the good work of our practitioners to be scarred due to illegal practices of a few individuals,” added Mkhize.

The Health Professions Council of South Africa (HPCSA) wishes to advise that Med-X Training Institute, 88 Westbourne Road, Mount Croix, Port Elizabeth is not accredited to offer Basic Ambulance Assistant training.

 

In terms of section 16 of the Health Professions Act, 1974 (Act 56 of 1974) all institutions offering emergency care training which fall within the scope of the professions under the ambit of the Professional Board for Emergency Care Practitioners must be accredited and are obliged to comply with the conditions of accreditation as well as the education and training standards as determined by the Professional Board for Emergency Care Practitioners.
